Berikut ini leher pemberitaan pasalnya”Kepolisian Negara Republik Indonesia (Polri) mengirimkan delapan personel ke Filipina untuk ikut melakukan koordinasi terkait kasus warga negara Indonesia (WNI) bernama Anton Gobay yang ditangkap Kepolisian Filipina”.

Merespon hal itu, Terkait negara Indonesia Deportasi dengan cara mengoordinasi kepada negara pilipina dari negara Indonesia.

Panglima Tertinggi tentara pembebasan nasional  Papua Barat-organisasi papua merdeka-west Papua army (TPNPB-OPM-WPA) sudah mengeluarkan pernyataan sikap bahwasanya Panglima Tertinggi WPA “meminta pemerintah Filipina tidak mendeportasi Tuan ANTON GOBAI ke Indonesia. Hal itu terlansir dalam media jubi.id pada January 10, 2023

Deportasi ke Indonesia  tidak ada dasar hukum yang menjamin.
Hal mengenai   Deportasi ke Indonesia kami telah melayangkan sebuah surat ketiadaan Atau penolakan karena melanggar kedaulatan negara menganggap hal itu intervensi otoritas hukum negara pilipina dan surat itu tersampaikan melalui juru bicara khusus KSAU TPNPB-OPM-WPA Tuan ANTON GOBAI di Media.www.jalapaua.com pada Januari 09 2023 kemarin.

Bahwasanya,berikut ini isi pemberitaan nya,  “Karena penangkapan ini adalah penangkapan lintas negara Hukum kebiasaan internasional pun telah menyatakan bahwa negara lain tidak dapat melakukan intervensi terhadap wilayah kedaulatan negaranya dengan adanya pernyataan hukum internasional maka negara pilipina menjadi Otoritas full dalam penanganan kasus ini”.

Di samping itu juga, penangkapan lintas negara melanggar prinsip itikad baik (Pasal 26 dari Konvensi Wina tentang Hukum Perjanjian Internasional dan Pasal 2(2) dari Piagam PBB). Langkah pertama dari perwujudan prinsip itikad baik tersebut adalah melalui kerjasama internasional (Pasal 86 dari Statuta Mahkamah Pidana Internasional dan Pasal 88 dari Protokol Tambahan Pertama Konvensi Jenewa).merupakan pedoman dalam peniadaan kerja sama yang kriminal dengan negara lain seperti kepolisian Filipina mendeportasi ke kepolisian Indonesia dalam hal menindaklanjuti perkara Tuan ANTON GOBAI Indonesia dan lain-lain.

besok negara   Indonesia akan koordinasi dengan kepolisian Filipina maka dengan itu kami seluruh rakyat papua, tentara Pembebasan nasional Papua Barat-organisasi Papua Merdeka- TPNPB-OPM dan seluruh organisasi Papua mereka dengan tegas menolak Kepolisian Filipina deportasi Tuan ANTON GOBAI Ke  ke Indonesia .

Jika besok atau seterusnya kepolisian pilipina  mengadili Tuan ANTON GOBAI di pengadilan Kepolisian Filipina sesuai dengan perundang-undangan yang berlaku maka berikut ini sebagai bagian dari pada Pedoman menurut undang-undang yang berlaku di seluruh dunia.

Bahwa Dalam melaksanakan penangkapan wajib dipertimbangkan hal-hal sebagai berikut:
Pertama, keseimbangan antara tindakan yang dlakukan dengan bobot ancaman;

Kedua, senantiasa menghargai/menghormati hak-hak tersangka yang ditangkap; dan
Ketiga,tindakan penangkapan bukan merupakan penghukuman bagi tersangka.

Secara umum, kewajiban petugas kepolisian dalam melakukan penangkapan, yaitu:

memberitahu/menunjukkan tanda identitasnya sebagai petugas Polri;
menunjukkan surat perintah penangkapan kecuali dalam keadaan tertangkap tangan;
memberitahukan alasan penangkapan;

menjelaskan tindak pidana yang dipersangkakan termasuk ancaman hukuman kepada tersangka pada saat penangkapan;

senantiasa melindungi hak privasi tersangka yang ditangkap; dan
memberitahu hak-hak tersangka dan cara menggunakan hak-hak tersebut, berupa hak untuk diam, mendapatkan bantuan hukum dan/atau didampingi oleh penasihat hukum, serta hak-hak lainnya sesuai Undang-undang.

Kami berdiri dengan patriotik Papua Barat, senegaranya yang ditangkap di Filipina.

Silahkan bebaskan kepada Pak Anton Gobay.  Dia adalah Pejuang Kemerdekaan sejati kami untuk rakyat Papua Barat.

Biarkan dia Bebas, Filipina sebagai negara tetangga masa depan kita dapat memahami kondisi politik Papua Barat yang sedang terjadi.

Harap amankan Dia, Tuan Anton Gobay Di penjara Filipina dan kami berharap semua proses di tutupi sepenuhnya untuk dia sebagai warga negara penting Papua Barat.
